  1. The Privacy and Cookie Policy applies to the Controller’s processing of data and use of cookies on the Website.
  2. The Controller performs the functions of obtaining information about Users and their behaviour in the following way:
  1. by voluntary input of information by the User in the forms,
  2. by storing cookies on user devices.
  1. The Controller collects data to the extent necessary to provide services by Most Unique Art.
  2. The Controller takes due care to respect the privacy of the Users of the Website
  3. Using the Website is conditional upon reading the Terms and Conditions and this Privacy Policy.

    INFORMATION ON FORMS
  1. The data provided in the form is processed for the purpose resulting from the function of the specific form, such as for the purpose of placing an order (payment, shipment, complaint), inquiry about an artwork (to answer the User’s question).
  2. Conclusion of a contract of sale by the User with the Controller who is the seller involves the processing of User’s personal data and entrusting its processing to the Controller in order to implement the concluded contract of sale. Marked data is required in order to accept and process the order and failure to do so will result in the order not being processed. Within the Website, the Controller may process information constituting the User’s personal data to enable the performance of the concluded contract of sale.
    The User provides the following data:

  3. phone number,
  4. post code and town/city,
  5. street with house / apartment number,
  6. country,
  7. bank account number.

  3. compliance with regulatory obligations to which the controller is subject under tax and accounting regulations – the legal basis for processing is a legal obligation (Article 6(1)(c) GDPR),
  4. possible exercise of legal claims, the legal basis for the processing is the Controller’s legitimate interest in protecting its rights (Article 6(1)(f) GDPR),
  5. for analytical and statistical purposes, the legal basis for processing is the legitimate interest of the Controller (Article 6(1)(f) GDPR).
  1. When using the Controller contact form, it is required to provide personal information necessary to contact the User (name, e-mail address). Failure to provide or providing an incorrect e-mail address will result in the inability to answer the inquiry. Data marked as mandatory is required in order for the inquiry to be accepted and processed.
    In this case, personal data is processed for the purpose of:
    1. identifying the sender and answering the inquiry submitted in the contact form, the legal basis for the processing is the necessity of the processing for the performance of the service contract (Article 6(1)(b) GDPR),
    2. for analytical and statistical purposes, the legal basis for the processing is the legitimate interest of the Controller (Article 6(1)(f) GDPR)
  2. In the case of expressing the will to use the Newsletter service, the User provides only an e-mail address, and the basis for data processing is the consent of the data subject to provide the Newsletter service (Article 6(1)(a) GDPR).

    USE OF COLLECTED DATA
  1. The Controller uses personal data in order to perform the services provided through the Website, i.e. to handle processing arising from the function of a specific form; e.g. to make an inquiry or to place an Order (payment, shipping, complaint).

The Controller, as part of the User’s use of the Website, may collect additional information, in particular: the IP address assigned to the User’s terminal equipment or the external IP address of the Internet provider, domain name, browser information, operating system type, access time, and may collect navigational data, information about the links and references used on the Website and information collected through cookies and process it in order to provide Users with a better service, analyse statistical data and adapt the Website to Users’ preferences, as well as for the purpose of administering the Website.
    The above data is not associated with specific individuals browsing the sites – it is anonymous under the law.
  3. In case of expressing the will to use the Newsletter service, the Controller will send e-mails containing commercial information on promotions and new products available on the Website.
  4. Without express consent, personal data will not be shared with other data recipients, except with the Controller’s IT service subcontractors for the purposes of maintaining the Website.

  1. obtain from the Controller free access to your personal data,
  2. obtain from the Controller the rectification of your personal data,
  3. obtain from the Controller the erasure of your personal data,
  4. obtain from the Controller restriction of processing of your personal data,
  5. object to the processing of your personal data,
  6. data portability,
  7. lodge a complaint with the supervisory authority (Inspector General for the Protection of Personal Data – GIODO or its legal successor).
  1. All information regarding the User’s rights in terms of access, change, being forgotten, rectification, erasure and withdrawal of consent can be obtained by calling the contact number provided in the “CONTACT” tab.

    The request should, as far as possible, indicate precisely what the request is about, i.e. in particular:
  1. what right the requester wants to exercise (e.g., the right to receive a copy of the data, the right to erasure, etc.),
  2. which type of processing the request concerns (e.g., receiving a Newsletter containing commercial information to a specific email address, etc.),
  3. what processing purposes the request relates to (e.g., marketing purposes, analytical purposes, etc.),
  1. If the Controller is unable to determine the substance of the request or identify the requester based on the request made, the Controller will ask the User for additional information.
  2. The response will be provided to the e-mail address from which the request was sent, and in the case of requests sent by letter, by regular mail to the address indicated by the User, unless the content of the letter indicates a desire to receive feedback to the e-mail address (in which case the e-mail address must be provided).

    SHARING PERSONAL DATA
  1. Data is only shared with third parties within the limits permitted by law.
  2. The Controller uses the collected personal data to perform the services provided on the Website. Personal data provided voluntarily to the Controller will be disclosed to external entities participating in the implementation of the concluded sales transactions: bank service providers, legal entities, courier companies, entities providing accounting services, invoicing software providers.
  3. The recipients of the data may be IT service providers of the data controller, which are subcontractors of IT services, for the purposes of maintaining the Website and IT systems.
  4. Navigational data may be used to provide Users with a better service, analyse statistical data and customize the Website to Users’ preferences, and administer the Website.
  5. If the User subscribes to the Newsletter, the Controller will send e-mails containing commercial information about promotions and new products on the Website to the User’s e-mail address.

The Controller reserves the right to disclose selected information concerning the User to competent authorities or third parties who make a request for such information on the appropriate legal basis and in accordance with the provisions of the applicable law, in particular to organizational units of the Prosecutor’s Office, the Police, the President of the Office for Personal Data Protection, the President of the Office for Competition and Consumer Protection or the President of the Office of Electronic Communications.

    PERIOD OF PROCESSING PERSONAL DATA

Personal data is stored for the period from the moment of placing an order by the User until its execution by the Controller, as well as after its completion for the purpose of fulfilling obligations under the law, including accounting and tax, statistics and archiving. Personal data for marketing purposes are kept until withdrawal of consent to their processing.
  2. The period of processing may be extended where processing is necessary for the establishment, exercise or defence of possible claims, and thereafter only if and to the extent required by law. After the expiration of the processing period, the data shall be irreversibly removed or anonymized.

The personal data collected by the Controller through the Website shall be processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR).
  2. The Controller conducts risk analysis on an ongoing basis in order to ensure that personal data is processed by them in a safe manner – ensuring first of all that only authorized persons have access to the data and only to the extent that it is necessary due to the tasks performed by them.
  3. The Controller shall take all the necessary measures to ensure that other cooperating entities guarantee the application of appropriate security measures whenever they process personal data on behalf of the Controller.
